Welcome to ZISTY Home! The terms “we,” “us,” and “our” refer to ZISTY Home, a company founded and managed by Guamra Janati. ZISTY Home operates the website www.zistyhome.com (hereinafter the “Site”), including all related information, content, features, tools, products, and services, to provide you, as a customer, with a personalized shopping experience (hereinafter the “Services”). The Site is hosted on the Shopify platform.

These Terms of Service, together with our General Terms and Conditions of Sale (GTC) , our Refund Policy , our Shipping Policy and our Privacy Policy , describe your rights and obligations when you use the Services.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and all of our policies. If you do not agree to these terms, you must not use or access our Services.

By accepting these Terms of Service, you represent that you are at least 18 years old or have reached the age of majority in your country of residence. If you are a minor, you must obtain the consent of your legal guardian to use the Services.

To use the Services, including accessing our online store, browsing our products, or making a purchase, you may be asked to provide certain information such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, and complete.

You are solely responsible for maintaining the security of your account credentials and for all activities conducted under your account. You are not authorized to transfer, sell, or assign your account to any third party.

Section 3 – Our products

ZISTY Home offers products in the following categories: tableware, table accessories, coffees and alternatives, teas and infusions, gourmet food and decoration.

We strive to provide an accurate representation of our products on the Site. However, the colors or appearance of the products may vary slightly due to your screen display settings. These minor differences do not constitute a defect in conformity.

All product descriptions are subject to change at any time. We reserve the right to limit the quantities of any product we offer, without discrimination.

Section 4 – Commands

When you place an order, you are making a purchase offer. Your order is only definitively accepted after confirmation by ZISTY Home and payment processing. You will receive a confirmation email summarizing your order and its main terms and conditions.

Please review your order carefully before submitting it. If we are unable to accept, modify, or cancel an order, we will notify you at the email address or phone number you provided when placing the order.

Returns and exchanges are governed by our General Terms and Conditions of Sale and our Refund Policy .

Section 5 – Price and Payment

5.1 Price

Prices are shown in euros (€), inclusive of all taxes (VAT), but excluding delivery charges. Delivery charges are calculated separately and communicated to the customer before order confirmation. The applicable price is the one displayed at the time of order confirmation.

Prices and promotions may be changed at any time, without affecting orders already confirmed.

5.2 Payment

Payment is made at the time of ordering via the following methods: credit card (Visa, Mastercard, American Express), PayPal, Apple Pay, Google Pay, Bancontact, Shop Pay, Maestro or Union Pay.

Payment is secured by the Shopify platform using SSL encryption. ZISTY Home does not store any payment data.

You represent and warrant that the payment information provided is accurate, that you are authorized to use the chosen payment method, and that the amounts billed will be honored by your bank.

Section 6 – Shipping and Delivery

The products offered on the Site come from various specialized suppliers. Therefore, an order may result in several separate shipments with varying delivery times. The indicative delivery times are as follows:

• Belgium: 3 to 7 business days
• France and neighboring countries: 5 to 10 business days
• Rest of the European Union: 7 to 15 business days

In accordance with European legislation, delivery will take place within a maximum of 30 days from order confirmation, unless otherwise agreed. If this deadline is exceeded, the customer may cancel their order and receive a full refund.

Free delivery is offered for orders over €80. Delivery costs are clearly detailed before order confirmation.

A tracking number is provided by email for each shipment. The customer is required to check the condition of the package upon receipt and report any damage within 48 hours to contact@zistyhome.com .

Section 7 – Right of withdrawal and returns

In accordance with European Directive 2011/83/EU and the Belgian Code of Economic Law, you have a right of withdrawal of 14 calendar days from the day after receipt of the product (or the last product in the case of split delivery), without having to give reasons or pay any penalty.

In addition, ZISTY Home grants an extended return period of 30 days as a goodwill gesture, subject to the same conditions.

In the event of cancellation, ZISTY Home will refund all sums paid, including initial delivery costs (based on the standard rate), within a maximum period of 14 days.

Items on promotion or sale remain subject to the right of withdrawal under the same conditions as full-price items.

Section 8 – Legal Guarantee of Conformity

In accordance with European and Belgian legislation, you benefit from a 2-year legal guarantee of conformity from the date of delivery of the product. In the event of a lack of conformity, you can request repair, replacement, a price reduction, or cancellation of the contract.

Section 9 – Intellectual Property

All elements of the Site (texts, images, logos, visuals, trademarks, graphics, databases, product names, slogans) are the exclusive property of ZISTY Home or its partners and are protected by Belgian, European and international laws relating to intellectual property.

These Terms authorize you to use the Services for personal and non-commercial purposes only. Any reproduction, distribution, modification, public display, republication, or exploitation of these elements is strictly prohibited without the prior written consent of ZISTY Home.

Shopify's names, logos, and trademarks are the property of Shopify Inc. All other names and logos appearing on the Site are the property of their respective owners.

Section 10 – Third-Party Tools and Services

The Site may integrate tools or functionalities provided by third parties (payment systems, order tracking, analytics). These tools are provided "as is" and ZISTY Home does not guarantee their permanent availability or error-free operation.

The Site may contain hyperlinks to third-party websites. ZISTY Home is not responsible for the content, accuracy, or practices of these sites. Accessing these third-party sites is at your own risk.

Section 11 – Relationship with Shopify

ZISTY Home is hosted by Shopify, which provides the technical infrastructure to offer you the Services. However, the sales and purchases you make are processed directly with ZISTY Home.

By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and ZISTY Home, including any harm or damage resulting from purchased products and services. You expressly release Shopify and its affiliates from any and all claims arising from your purchases and transactions with ZISTY Home.

Section 12 – Protection of personal data (GDPR)

ZISTY Home collects and processes personal data in accordance with the General Data Protection Regulation (GDPR – EU Regulation 2016/679).

The data collected (name, address, email, telephone, order history) is used exclusively for order processing, delivery, customer relationship management and, with your consent, sending commercial communications.

Section 13 – User Content and Reviews

If you submit reviews, comments, ideas or any other content (hereinafter "User Content"), you grant ZISTY Home a non-exclusive, worldwide, royalty-free license to use, reproduce, modify and display such content in connection with the operation and promotion of the Services.

You represent and warrant that your User Content does not infringe any third-party rights, and does not contain illegal, defamatory, obscene, or malicious material. ZISTY Home reserves the right to moderate or remove any inappropriate content.

Section 14 – Prohibited Uses

You may only use the Services for lawful purposes. In particular, it is prohibited to:

• Using the Services for illegal or malicious purposes
• Violating any local, national or international regulations
• Infringing the intellectual property rights of ZISTY Home or third parties
• Harassing, insulting or harming our employees or other users
• Transmitting false or misleading information
• Sending unsolicited advertising content (spam)
• Impersonating a third party
• Introducing viruses or malware
• Reproducing, copying, reselling or exploiting the Services without authorization
• Collecting other users' personal data
• Interfering with the Site's security functions

ZISTY Home reserves the right to suspend or terminate your account in the event of a violation of these Terms.

Section 15 – Responsibility

ZISTY Home is committed to providing the Services diligently. However, ZISTY Home cannot be held liable for:

• Non-performance of the contract in the event of force majeure (natural disaster, transport strike, pandemic, etc.)
• Damage resulting from misuse of the products by the customer
• Temporary interruptions of the Site for maintenance or updates
• Content or practices of third-party websites accessible from the Site

ZISTY Home's liability is limited to the amount of the order paid by the customer. This limitation does not apply in cases of intentional misconduct or fraud, nor to consumer rights guaranteed by European and Belgian law, which cannot be excluded or limited contractually.

Section 16 – Errors and Inaccuracies

Occasionally, information on the Site may contain typographical errors, inaccuracies, or omissions regarding product descriptions, prices, promotions, or availability. We reserve the right to correct any errors and update information at any time. In the event of a clear pricing error, we will inform you before processing your order.

These Terms of Service are governed by Belgian law .

In accordance with European regulations, you can use the European Commission's Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr .

You can also contact the Consumer Mediation Service (SMC) in Belgium.

In the absence of an amicable settlement, the competent courts of Liège (Belgium) shall have jurisdiction over any dispute relating to these Conditions.

You can view the most recent version of the Terms of Service on this page. We reserve the right to modify these Terms at any time. Significant changes will be communicated to you in accordance with applicable law.

Continuing to use the Services after changes are posted constitutes acceptance of those changes. The applicable version is the one in effect at the time of using the Services.

Section 19 – General Provisions

Severability: If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver: ZISTY Home's failure to exercise any right provided for herein shall not constitute a waiver of that right.

Entire Agreement: These Terms of Service, together with our Terms and Conditions and policies, constitute the entire agreement between you and ZISTY Home regarding the use of the Services.

Assignment: You may not assign or transfer these Terms without our prior written consent. ZISTY Home may transfer its rights and obligations without prior notice.
